By accessing or using the Dream Castings website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. These Terms apply to all visitors, users, applicants, talent, clients, and others who access or use our platform.

2. Description of Services

Dream Castings is a professional talent representation and casting agency. Our services include, but are not limited to:

  • Talent scouting, representation, and management for models and actors
  • Casting services for commercial, editorial, film, television, and digital projects
  • Connecting talent with clients, brands, and production companies
  • Portfolio development and career guidance for represented talent
  • Event staffing and brand ambassador services
  • Travel sponsorship and international placement for selected talent

Dream Castings reserves the right to modify, suspend, or discontinue any aspect of its services at any time without prior notice.

3. User Accounts and Registration

Certain features of our platform may require registration or submission of personal information. When creating an account or submitting an application, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Application Submissions

When submitting an application to Dream Castings, you acknowledge and agree that:

  • Submission of an application does not guarantee representation or employment
  • All information provided must be truthful and accurate
  • You are at least 16 years of age, or have obtained verifiable parental or guardian consent
  • We may contact you regarding your application via the information provided
  • Applications are reviewed at our discretion and we are under no obligation to respond to every submission
  • Duplicate applications may be rejected automatically
  • We reserve the right to retain application data in accordance with our Privacy Policy

5. Intellectual Property

The Dream Castings website, including its design, logos, text, graphics, icons, images, audio clips, digital downloads, and software, is the property of Dream Castings and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

6. Content Ownership and Usage Rights

By submitting photos, videos, or other content ("User Content") to Dream Castings, you:

  • Grant Dream Castings a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display your User Content for the purposes of providing our services, including but not limited to portfolio presentation, client submissions, and marketing activities
  • Represent and warrant that you own or have the necessary rights to the User Content
  • Acknowledge that User Content may be shared with potential clients, casting directors, and production companies as part of our normal business operations
  • Retain ownership of your User Content, subject to the licence granted above

You may request removal of your User Content by contacting us. Removal will be processed within a reasonable timeframe, subject to any existing contractual obligations.

7. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

8. Prohibited Activities

You agree not to engage in any of the following activities:

  • Providing false or misleading information in applications or communications
  • Impersonating another person or entity
  • Using the platform for any unlawful purpose or in violation of any applicable laws
  • Attempting to gain unauthorised access to our systems or other users' accounts
  • Interfering with or disrupting the integrity or performance of our platform
  • Scraping, data mining, or using automated tools to collect data from our website
  • Uploading content that is defamatory, obscene, or infringes on the rights of others
  • Soliciting talent or clients away from Dream Castings without prior written consent
  • Using our platform for spam, phishing, or other malicious activities

9. Limitation of Liability

To the fullest extent permitted by applicable law, Dream Castings and its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any conduct or content of any third party on our platform
  • Unauthorised access, use, or alteration of your content or information
  • Any casting decisions, bookings, or employment outcomes

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to Dream Castings in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Dream Castings, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of our services
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any content you submit or transmit through our platform

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use our services will cease immediately. If you wish to terminate your account or representation agreement, you may do so by contacting us in writing. Termination of representation is subject to any existing contractual obligations between you and Dream Castings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of our services after any changes to these Terms constitutes acceptance of those changes.
